Monaco¶
Monaco freezes assets on other people’s lists as a matter of law: the measures of the Security Council, of the Union, of France or of any other state become Monegasque freezes by ministerial decision. A principality that small cannot afford a foreign policy of its own and has written that into its administration. The weakness is the open clause. The gate through which another government’s list enters local law is already built, and what passes through it is for the minister to decide, not a court; the principality’s banks, like their neighbours’, are likely to read the list before anyone reads the law.
The clerk’s briefs¶
From the clerks, for the Patrician’s eyes
Nothing to read yet. Residents and companies with money in Monaco can find it frozen on another state’s list by a minister’s decision, with no court in between. Which states’ lists are let through decides, in practice, who governs their accounts, and a list written for one purpose can be applied for another.
Nothing filed yet¶
The clerks have found no dated development in the period that bears on the steps of the historical record. The standing arrangement is on Monaco’s asset-freeze portal: sanctions “decretees par l’Union europeenne et la Republique francaise ou par un autre Etat” are applied, and the national freeze list is published. The hinge they would watch is which other state’s lists are let through.
